Why Go to Court If You Don't Have To?

Most people going through a separation assume that lawyers mean courtrooms. It does not have to work that way.

Collaborative Family Law is a process where both parties work together — each with their own trained lawyer — to reach a fair agreement outside of court. No judge. No courtroom. No drawn out litigation.

At Knights Law, we recommend this approach for most family law matters. Our lawyers are among a select few in the Niagara Region with specialized training in Collaborative Law.

What is Collaborative Family Law?

  • Collaborative family law is an alternative dispute resolution process where couples voluntarily work together to resolve their legal issues without going to court and through the assistance of collaborative family lawyers. In some cases, this process may also include collaborative professionals such as financial specialists and/or social workers. This process begins through a mutual agreement between both parties that they endeavour to resolve their conflicts respectfully and with minimal conflict. From there a separation agreement is drafted that both parties agree to. Collaborative family lawyers also have specialized training in things like:

Dispute resolution tactics to get parties to agree and cooperate with each other

  • Providing solutions that serve in both parties’ best interests while simultaneously taking individual rights into consideration

  • Encouraging and supporting both sides to speak openly and honest with each other

  • Ensuring that all financial documents are taken into consideration to make informed decisions

WHY IT WORKS SECTION:

Why Families Choose Collaborative Law

The Collaborative process is not just a cheaper alternative to court. It produces genuinely better outcomes in most situations.

When families work through their separation collaboratively, agreements tend to hold longer because both parties had a hand in building them. Communication between co-parents improves because the process is designed around respect, not confrontation. Children are protected from the stress of prolonged conflict. And the financial cost is almost always significantly lower than contested court proceedings.

It is not the right fit for every situation. But for families who are willing to work toward resolution, it is almost always the better path.

IS IT RIGHT FOR YOU SECTION:

Is Collaborative Law Right for Your Situation?

Collaborative Family Law works best when both parties are willing to participate in good faith. It requires a genuine commitment to resolving matters respectfully.

It may not be appropriate in situations involving significant power imbalances, safety concerns, or where one party is unwilling to engage honestly in the process.

If you are unsure whether this approach is right for your situation, the best first step is a consultation. We will listen to your circumstances and give you an honest assessment of your options.
