  • How the Collaborative Process Works

    The Collaborative Law process follows a clear, structured path. Here is what it looks like in plain terms:

    Both parties agree to resolve things outside of court. This is the foundation. Collaborative Law is voluntary. Both people commit at the start to working toward a resolution without involving a judge.

    Each person has their own lawyer. You are not sharing a lawyer. Each party has independent legal counsel who advises and advocates for them throughout the process. The difference is that both lawyers are also trained to facilitate agreement rather than escalate conflict.

    You meet together to work through the issues. Through a series of structured meetings, both parties — with their lawyers present — work through the key issues. This can include parenting arrangements, finances, property, and support.

    Specialists can be brought in when needed. If financial matters are complex, a financial specialist can be included. If children's needs require attention, a family specialist or social worker can join the process. Everyone at the table is there to help reach a resolution.

    A separation agreement is drafted and signed. Once both parties reach an agreement on all matters, a formal separation agreement is prepared. This is a legally binding document that reflects everything decided through the process.
